Non-Resident Income Tax (IRNR) is the Spanish tax charged on individuals and companies that are not tax residents in Spain but have income or certain taxable interests linked to the country. This is especially relevant for foreign property owners, as the tax may apply not only to rental income, but also to imputed income on a property that is kept for personal use or left vacant, as well as capital gains when selling a property in Spain. In some cases, Spanish-source dividends or interest may also fall under this tax. Because the rules vary depending on the type of income and the taxpayer’s circumstances, IRNR is a key tax area for non-residents to understand when owning property in Spain.

Non-resident property owners in Spain must declare and pay tax on any income they earn from renting out their property in the country. This is done by submitting Modelo 210, a special tax declaration form for non-residents.

Capital Gains Tax applies when a non-resident sells property in Spain and makes a taxable profit on the sale. The amount due depends on the gain calculated under Spanish tax rules, and the declaration is generally made through Modelo 210.
